Rapper Kevin Gates waives extradition to Illinois on weapons charges
BARTOW — Rapper Kevin Gates will be returning to Illinois to face weapons charges.
The 31-year-old entertainer was about to be released from the Polk County Jail when the Cook County, Ill., felony warrant was found.
He had been serving a 180-day sentence after being convicted in October 2016 for kicking an 19-year-old woman during a performance on Aug. 30, 2015, at a Lakeland nightclub.
During a first appearance hearing at 1 p.m. Friday in the Polk County Courthouse, Gates waived extradition to Cook County. He will be picked up by Illinois authorities within 30 days, said Assistant State Attorney Jake Orr. Chicago is in Cook County.
To waive extradition means a defendant agrees to return to the jurisdiction where he faces charges without a court hearing to determine whether the transfer is justified.
Circuit Judge Kelly Butz ordered him held without bail.
Gates, whose real name is Kevin Jerome Gilyard, is wanted on a felony warrant charging him with a weapons offense, issued by the Cook County Sheriff's Office. Gates has a lengthy rap sheet that includes terms in prison and several gun charges from 2013 in Illinois, including aggravated unlawful use of a weapon, according to the Tampa Bay Times.
In October, Gates told the six-member County Court jury that he feared being pulled off the stage and he "just kicked at the hands that were grabbing me." He was performing in the Rumors Niteclub, off Memorial Boulevard in Lakeland, in front of a packed audience.
Jurors convicted the rapper of the misdeamenor charge.
Miranda Dixon testified that she just wanted to touch the multiplatinum recording artist. She reportedly grabbed at Gates' shorts before being kicked. She said she suffered bruising to her stomach.

On Friday (March 24), Kevin Gates was arrested again, on the day he was originally set to be released from jail. According to TMZ, Gates was on the cusp of freedom until authorities spotted an outstanding weapons-related warrant in his files. Gates was sent back into jail and has a hearing scheduled later for today.
In 2015, Gates was charged with battery after he allegedly kicked a female fan in the chest during a show in Florida.
WFLA reports that 19-year-old Miranda Dixon claimed that she tugged at Gates' pants twice in hopes of getting his attention for her friend. "I was trying to get his attention for my friend," she said during the trial. Dixon alleged that the "2 Phones" rapper kicked her so hard that she passed out.
On the stand, Gates admitted to kicking her, but only as a form of self-defense. “I kicked them, I wanted them off me,” he said.
A jury of six women found Gates guilty and sentenced him to 180 days in prison. Because of his prison stint, Gates was also forced to skip out on several performances, including an appearance at 2016 Voodoo Fest.
Gates' rep offered no comment.

As he was being processed out of jail, officials found an out-of-state warrant which cites an outstanding weapons charge in Illinois.
The 31-year-old was immediately arrested again and is currently being held in Florida's Polk County Jail.
According to the Polk County Sheriff's Office, Gates is waiting to be extradited to Illinois' Cook County, where the charges originated.
